Terms & Conditions 

Titanomachy International, Inc., ("NBA Store Philippines," "we," "us") website(s) (our "Site" or "Sites") and related services are made available to you pursuant to the following Terms of Use & Service and any other rules posted on our Sites (collectively, the "TOS"). Please read the TOS carefully before placing any orders on NBASTORE.COM.PH. We recommend keeping a copy of the TOS for future reference.

In particular, we wish to draw your attention to our policies relating to the terms of purchase within the TOS and our Privacy Policy. If you are under 18, you must let your parent or guardian know about NBASTORE.COM.PH's Privacy Policy before registering to use this Site or any of its services. We reserve the right to only accept orders from those over 18 years of age.

We may modify the TOS from time to time. Please read the TOS and check back often. If you do not agree to any change to the TOS, then you must immediately stop using the Site. Any changes made after you have placed an order will not affect that order, unless required by law. 

Registration 

Registration of an account is required to place an order on NBASTORE.COM.PH. Upon registering, users are required to provide true, accurate, current, and complete personal information in all required fields. Should any submitted information change, please email hello@nbastore.com.ph to request revisions. Registration requirements are subject to change without prior notice.

Eligibility 

In order to make purchases through the Site, inputting personal information is required. Customers must provide their real name, phone number, email address, and other requested details. When ordering items, customers will be required to provide valid payment details and represent that the payment details provided are both valid and correct, confirming that they are the person referred to in the Billing information provided.

The Site is available to individuals who meet the NBASTORE.COM.PH terms of eligibility, who have been issued a valid payment method acceptable to NBASTORE.COM.PH, and who have authorized charges for the total purchase price of the merchandise. NBASTORE.COM.PH reserves the right to restrict multiple quantities of an item shipped to any one customer or postal address.

By making an offer to purchase merchandise, you expressly authorize us to perform credit checks and, where NBASTORE.COM.PH deems necessary, transmit or obtain information about you to or from third parties (including credit card numbers or credit reports) to authenticate your identity, validate your credit card, and authorize individual transactions.

Furthermore, you agree that we may use personal information provided by you to conduct appropriate anti-fraud checks. Personal information provided may be disclosed to credit reference or fraud prevention agencies, which may keep a record of that information. Please refer to our Privacy Policy for further information. 

Orders

All orders are subject to acceptance and availability. NBASTORE.COM.PH offers products for sale that are in stock and available for dispatch from our distribution center. Please note that items inside the cart are not reserved and may be purchased by other customers. By accepting these terms and conditions, you also accept the terms outlined on the Return Policy page regarding cancellations, returns, and exchanges.

Limited Releases / Quick Strike Items 

Special rules and guidelines may be implemented on high-demand and limited releases to give the general public equal and fair chances to purchase:

  • First-Come, First-Served: Priority is determined based on the order timestamp.

  • Dispatch Schedule: All confirmed orders will be shipped out on the next business day.

  • Verification Checks: Additional verification may be conducted by the NBA Store Philippines Online Team for credit card and online payments.

  • Security Measures: Purchases made using automated tools, security circumvention, or access control bypasses will not be tolerated. NBASTORE.COM.PH reserves the right to cancel orders and suspend or close offending accounts.

No Purchase for Resale

NBASTORE.COM.PH is intended solely to sell products directly to end consumers. Purchase of products for resale is strictly prohibited. Purchase for resale refers to the purchase of products by someone who resells or intends to resell them to others. If NBASTORE.COM.PH suspects involvement in purchasing for resale, we reserve the right to restrict sales, cancel orders, and suspend or close your account.

Pricing Policy 

Prices shown on the Site are in PHP (₱, Philippine Peso) and are inclusive of VAT at the applicable rate. All prices and offers remain valid as advertised from time to time. The PHP price displayed at the time the order is accepted will be honored, except in cases of patent error.

Product prices are set using existing currency exchange rates and are subject to change if exchange rates shift or if items are marked down during the selling period. Customers will be charged for items purchased and applicable shipping costs only. If your payment method is not denominated in PHP or USD, the final price will be calculated according to your provider's exchange rate on the transaction date.

Acceptance of your Order 

Once an order is placed, you will receive an acknowledgment email. This email is NOT an acceptance of the order, but a confirmation that it has been received. Contract completion and acceptance of your order occur when we send an email confirming that the goods have been dispatched. The sales contract is concluded in the Philippines, and the language of the contract is English.

We reserve the right not to accept your order in the event that payment authorization cannot be obtained, shipping restrictions apply, the item is out of stock or fails quality control standards, or you do not meet eligibility criteria. We may also refuse service or process transactions at our sole discretion without liability.

Payment

Accepted payment methods include Visa & MasterCard debit/credit cards, e-wallets (GCash, GrabPay, Maya), BPI Direct Online Banking, and installment options (BillEase & Atome) via PayMongo. Over-the-counter transactions are facilitated via DragonPay. Payment is debited upon order dispatch. You confirm that the credit/debit card or account used belongs to you or that you have explicit authorization from the owner.

To help ensure a safe shopping experience, NBASTORE.COM.PH uses Secure Socket Layer (SSL) technology. While we take all reasonable care to secure order and payment details, in the absence of negligence on our part, we cannot be held liable for losses suffered if a third party gains unauthorized access to data provided when accessing or ordering from the Site. Items purchased using gift vouchers are non-refundable and non-exchangeable unless factory defects are present.

Insurance and Delivery 

NBASTORE.COM.PH insures each purchase during transit until delivery to your specified address. A signature upon delivery is required, transferring responsibility to the recipient. If a third-party recipient is specified (e.g., for gifts), signature proof at the address constitutes delivery fulfillment.

We aim to dispatch all orders within two (2) business days. Estimated delivery timelines are guides commencing from the dispatch date and do not account for delays caused by destination clearance processes or external restrictions. Once fulfilled, tracking numbers and links will be sent via email, and transaction records are stored for a minimum of one year.

Intellectual Property Rights 

Your use of the Sites grants no rights in relation to copyright, designs, trademarks, or intellectual property rights relating to Content, including software, HTML code, images, audio, video, or text. Reproduction or redistribution of Content is strictly prohibited and may result in civil and criminal penalties. Users may make one copy for personal, non-commercial viewing only.

NBASTORE.COM.PH strives to ensure information accuracy but does not promise that Site content or functionality is completely error-free or that the server is free of viruses. Users are encouraged to maintain updated virus-checking software.

No Commercial Use 

This Site is for personal, non-commercial use only. You may not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, commercially exploit, create derivative works from, transfer, or sell any Content or software from this Site. You agree to be personally responsible for your activity on the Site. Prohibited behavior or TOS violations may result in temporary or permanent access restriction.

Third-Party Sites 

The Site may contain hyperlinks to external websites operated by third parties. NBASTORE.COM.PH is not responsible for the content, privacy practices, or availability of these external resources.

Under Philippine law, customers possess statutory rights ensuring products are of satisfactory quality, fit for purpose, and match descriptions. If NBASTORE.COM.PH breaches the TOS, liability is strictly limited to direct, reasonably foreseeable losses up to 100% of the total value of goods purchased. We are not liable for indirect losses, loss of profits, or failure to fulfill obligations due to events beyond reasonable control.

Compensation, Relationship, & Governing Law

  • Compensation: You agree to compensate, defend, and hold NBASTORE.COM.PH, its officers, directors, affiliates, and licensors harmless from any liabilities, claims, expenses, damages, and legal fees arising from your breach of the TOS or unauthorized use of your account.

  • Our Relationship: No joint venture, partnership, employment, or agency relationship exists between you and NBASTORE.COM.PH as a result of the TOS.

  • No Waiver: Failure to act regarding a breach does not waive our right to enforce remedies for subsequent or similar breaches.

  • Governing Law: The TOS and all associated policies are governed by and construed in accordance with Philippine law, with exclusive jurisdiction in Philippine courts.

NBASTORE.COM.PH is secured by SSL Encryption. This ensures that the data that is passed from the buyer to NBASTORE.COM.PH is safe and secure. Furthermore, NBASTORE.COM.PH checks and validates transactions to ensure that the buyer and the credit card owner are one and the same person.
