OFFICIAL RULES

The NBA “Happy New Year” Promo (the “Promo”) is a contest which gives participants a chance to win the offered prize, pursuant to these official rules (the “Official Rules”), which will be made available online at NBAStore.com.ph

By taking part in this Promo, the participants agree to be bound by these Official Rules and acknowledge that all decisions of NBA Entities are final and binding. These Official Rules apply only to this Promo and not to any other promotions, contests, or sweepstakes by NBA Entities.

PROMO SUMMARY:

PROMO PERIOD:

The Promo begins on January 1, 2021 at 12:01 am, Philippine Time, and ends on January 31, 2022 at 11:59:59 pm, Philippine Time (the “Promo Period”).

QUALIFICATIONS:

The Promo is open to the following (each, a “Participant”):

Legal residents of the Philippines, who are at least eighteen (18) years of age at the time of entry; and
Who made a purchase of any NBA merchandise amounting to at least One Thousand Two Hundred Thirty Five and 95/100 (PhP 1,235.99) via https://nbastore.com.ph/

Employees, officers, directors, agents and representatives, members of the household, immediate family members and/or those with whom such employees, officers, directors, agents and representatives are domiciled, of The National Basketball Association (“NBA”), NBA Properties, Inc., NBA Media Ventures, LLC, NBA Digital, the NBA and its member teams (the “NBA Entities”), Turner Networks, and each of their respective companies, subsidiaries, affiliates, officers, governors, owners, distributors, retailers, agents, advertising/promotion agencies and Idea Rebel Interactive Inc., and each of their respective parent companies, subsidiaries, affiliates, officers, governors, owners, distributors, retailers, agents, advertising/promotion agencies (the “Released Parties”) are not eligible to enter or win. For purposes of these Official Rules, “household members” means those people who share the same residence and/or mailing address at least three months per year with one or more NBA Entities, and “immediate family members” means any parent, spouse, sibling or child and their respective spouses.

The Sponsor reserves the right to verify the eligibility of the winner.

HOW TO ENTER:

During the Promo Period, visit the Website and purchase any NBA merchandise amounting to at least One Thousand Two Hundred Thirty Five and 95/100 (PhP 1,235.95). See the collection link here:
To qualify for the Promo, all purchases must be made on or before January 7, 2022 at 11:59:59 pm, Philippine Time.
Each Participant is limited to earn only one (1) entry per person and per email address during the Promo Period. Additional Entries received from the same Participant or the same email address shall be considered void.

The use of script, macro or any other device to automate or subvert the registration process is prohibited and all such registrations will be void.

The Released Parties, in their sole discretion and after showing proof of dishonesty, reserve the right to disqualify any person (and void his/her points) who tampers with the submission process, the operation of the Promo, or any other component of this Promo, or who is otherwise in violation of these Official Rules, and modify to the minimum extent necessary, suspend, or terminate this Promo (or any portion thereof) should virus, bugs, non-authorized human intervention or other causes, including but not limited to war, strikes, and/or acts of God, corrupt, or impair the administration, security, fairness or proper play of this Promo. The Released Parties reserve the right to suspend or modify the Promo at any time during the Promo Period if events beyond its control compromise the Promo’s fairness or integrity.

PRIZE:

Only one (1) winner (the “Winner”) will be drawn and will receive one (1) signed Jalen Green Jersey with an approximate retail value of PhP 45,906.88 (the “Prize”).

The Prize is awarded “as is” and without any warranty or guarantee, either express or implied by the Sponsor. All Prize details are at the Sponsor’s sole discretion. After Repair Value (“ARV”) of the autographed merchandise is subject to fluctuation based on the featured NBA player and current market value at the time of prize award.

All costs and expenses associated with the acceptance and use of any prize not specified herein as being awarded, including but not limited to all local taxes, are the Winner’s sole responsibility.

The Jersey size will be determined by the Sponsor.

PRIZE DRAW:

The Winner will be determined through a random draw from all eligible entries received during the Promo Period which take place on Tuesday January 11, 2022 at 12:00 pm, Philippine Time.

In the event of any error of any kind whatsoever, and provided that a specific Winner has not yet been announced, another potential winner will be selected according to the Official Rules. In this connection, the Sponsor reserves the right to hold another random draw amongst all eligible entries.

WINNER NOTIFICATION AND SELECTION:

The Winner will be notified on or before January 20, 2022 at 12:00 PM by a representative of the Sponsor via email and registered mail.
The full name of the Winner will also be posted on all NBA physical stores within the Philippines within seven (7) days after the draw.
The name of the Winner will likewise be published on the NBAStore.com.ph website on January 20, 2022 for thirty (30) days.
The Winner shall execute a Prize Claim Form and submit any other document required by the Sponsor within thirty (30) days from the date of receipt of documents.
The Winner has sixty (60) days from date of receipt of the notification from the Sponsor to claim the Prize.

The Participants are solely responsible for checking their email inboxes and/or the NBAStore.com.ph website to see if a winner has been selected.

If the Winner notification sent by e-mail and/or registered mail is returned as undeliverable, and a representative of the Sponsor is unable to contact the Winner in any other manner, such Winner shall be considered as disqualified. Thus, the Sponsor may re-award the Prize to an alternate winner selected in accordance with these Official Rules.

If the Winner cannot be reached, fails to accept the Prize, fails to comply with these Official Rules and its requirements, or fails to signify acceptance of the prize within sixty (60) calendar days from receipt of the notification via email and registered mail, the Prize shall be forfeited upon approval by the Department of Trade and Industry.

Upon prize forfeiture, no compensation will be given, and the Sponsor shall randomly select another winner, in accordance with these Official Rules.

All decisions of the Sponsor with respect to any aspect of this Promo, including without limitation, the eligibility of entries, are final and binding on all Participants in all matters as they relate to this Promo.

INDEMNIFICATION AND LIMITATION OF LIABILITY:

In no event will the Released Parties or their respective officers, directors, employees, representatives and agents, be responsible or liable for any damages or losses of any kind, including but not limited to, direct or indirect, incidental, consequential or punitive damages arising out of the Participant’s access to and use of the service and/or from the service.

In no event shall the Released Parties’ total liability for all damages, losses, or causes of action exceed One Hundred US Dollars (USD 100.00) which shall cover cases wherein two (2) or more winners are drawn without fault or negligence on the part of the NBA Entities and/or the Sponsor.

The NBA Entities shall have no liability whatsoever in relation to this Promo and will be released and held harmless from any claim, action, liability, loss, injury or damage, including, without limitation, personal injury or death to the Winner or any third party or damage to personal or real property due in whole or in part, directly or indirectly, by any reason, including the acceptance, possession, use or misuse of the prize and/or participation in this Promo.

The Released Parties are not responsible for lost, incomplete, inaccurate, garbled, late, delayed, undelivered or misdirected entries, registrations, theft, destruction; failures or malfunctions of phones/mobile devices (including wireless phones/headsets or otherwise wireless devices); interrupted or unavailable network, server, Internet Service Provider (ISP) or other connections; any error, omission interruption, defect or delay in any transmission or communication; traffic congestion on the Internet or for any technical problem, including, but not limited to, any injury or damage to the Participant’s or any other person’s computer or mobile device related to or resulting from participation in this Promotion; printing errors in any Promotion-related advertisements or other materials; the cancellation, or timing errors.

In addition to any other limitations of liability contained in the Official Rules or otherwise on the Sponsor’s website/s, including the Promo website, the Sponsor assumes absolutely no responsibility or liability for:

Any incorrect or inaccurate entry information, or for any faulty or failed electronic data transmissions;
Any unauthorized access to, or theft, destruction or alteration of entries at any point in the operation of this Promo;
Any technical malfunction, failure, error, omission, interruption, deletion, defect, delay in operation or communications line failure, regardless of cause, with regard to any equipment, systems, networks, lines, satellites, servers, camera, computers or providers utilized in any aspect of the operation of the Promo;
Inaccessibility or unavailability of any network or wireless service, the internet or website or any combination thereof;
Suspended or discontinued internet, wireless or landline phone service;
Any injury or damage to the Participants or to any other person’s computer or mobile device which may be related to or resulting from any attempt to participate in the Promo or download of any materials in the Promo, if any;
Any losses whatsoever, financial or otherwise, suffered by any person or entity in connection with the Promo and the Official Rules.

GENERAL CONDITIONS:

The Sponsor reserves the right to modify these Rules for clarification purposes without materially affecting these Official Rules. This is a Promo designed to increase consumer awareness of and interest in the Released Parties’ service.

In the event that the Promo is challenged by any legal or regulatory authority, the Released Parties reserve the right to discontinue or modify the Promo. In such event, the Sponsor shall have no liability to any entrants who are disqualified due to such an action. In the event of any ambiguity(s) or error(s) in these Official Rules, the Released Parties reserve the right to modify these Official Rules for clarification purposes or to correct any such ambiguity or error(s) without materially affecting the Official Rules of the Promotion.

NBA Entities reserve the right to withdraw, amend or suspend this Promo or to amend these Official Rules, in any way, in the event of an error, technical problem, tampering, unauthorized intervention, fraud, or any other cause beyond the reasonable control of the NBA Entities that interferes with the proper conduct of this Promo as contemplated by these Official Rules after approval by the Department of Trade and Industry of its written notice for such withdrawal, amendment or suspension of the Promo.

Any attempt to undermine the legitimate operation of this Promo is a violation of criminal and civil laws and should such an attempt be made, NBA Entities reserve the right to seek remedies and damages to the fullest extent permitted by law. After the corresponding notice has been approved by the Department of Trade and Industry, NBA Entities reserve the right to cancel, amend or suspend this Promo, or to amend these Official Rules, without prior notice or obligation to the public, in the event of any accident, printing, administrative, or other error or any kind, or for any other reason.

DATA PRIVACY POLICY:

Personal information of the Participants will:

be held by the Sponsor;
be used for, and accessible only to employees directly involved in the Promo, internal analysis by NBA Entities and its affiliates, agents and advertising and promotional agencies; and
not be disclosed to third parties.

By entering this Promo, each Participant consents to the NBA Entities and their agent’s collection, use and disclosure of entry information for the purposes of administering this Promo.

The NBA, its affiliates, and authorized third parties may use the Participant’s personal information for any legitimate purposes, which include, notification through messages about products and initiatives of the NBA and its partners, such as the latest news, discounts and contests.

INTELLECTUAL PROPERTY:

All intellectual property, including but not limited to trademarks, tradenames, logos, designs, promotional materials, web pages, source codes, drawings, illustrations, slogans and representations that appear on the Sponsor’s websites and other sites in connection with this Promo, are owned or controlled by the Sponsor and/or its affiliates. All rights are reserved. Unauthorized copying or use of any copyrighted material or intellectual property without the express written consent of its owner is strictly prohibited.
